Food promotion and children Action Plan consultation

At its open meeting in March, the Agency Board agreed to consult on an Action Plan on Food Promotions and Children's Diets. A copy of the Action Plan is attached below. The plan calls upon Government, schools, industry and others to work with the Agency to address the way in which foods are currently promoted to children, and in doing so to encourage children to eat a more healthy diet.

Consultation details
We invite your comments on the Action Plan. In particular, we would be grateful for your views in response to the following questions:
- What do you think about the content of the Action Plan? Do you consider that the measures proposed are appropriate? Are they addressed to the right parties? Do you consider that action should be taken in areas not currently covered in the Action Plan?
- What is your assessment of the achievability and likely effectiveness of the individual Action Plan? Do you consider that the various elements of the Action Plan will have a positive influence on the balance of children’s diets? What can the Agency do to encourage all stakeholders to contribute positively to taking the Action Plan forward? Do any elements of the Action Plan have particular implications for specific ethnic groups?
- What timescales would be appropriate for taking forward the Action Plan? The Action Plan includes timescales by which the Agency will aim to produce a variety of guidance and advice for stakeholders. Is it appropriate to set timescales for action by other parties? What should those timescales be? When would it be appropriate for the Agency to examine and report on uptake and action by other stakeholders?
Regulatory Impact Assessment
The consultation package includes a Partial Regulatory Impact Assessment (RIA). Its purpose is to assess and quantify the costs and benefits to consumers, businesses and other stakeholders of the new proposal. we would be grateful for your comments on the RIA.
In particular, we would be grateful if you could provide details of what costs and benefits you anticipate your organisation (or indeed other stakeholders) will incur as a result of the Action Plan being taken forward. In a number of places, the RIA invites stakeholder comments in response to specific questions. In addition, you may wish to bear in mind the following points:
- It would be helpful if you could differentiate between one-off costs (such as those incurred by redesigning labelling or re-formulating products) and ongoing or recurring costs (such as those incurred by changes in advertising revenue, employing additional staff or using alternative ingredients on an ongoing basis).
- Think about what indirect costs or benefits you may incur (e.g., will there be any 'knock-on' effects not currently considered by the RIA?)
- Are there areas in which costs and benefits may arise that are not currently discussed in the RIA?
- Finally, are there any areas in which the new requirements will impact on small businesses in particular?

This consultation has been prepared in accordance with the HM Government Code of Practice on Consultation, which states that a consultation must follow better regulation best practice, including carrying out an Impact Assessment (Regulatory Impact Assessment in Scotland). The assessment is included in the consultation documents.
